Terms of Service Agreement

 

This Terms of Service Agreement ("Agreement") is a legal agreement between you ("User") and Electric Endeavors LLC ("Company") governing the use of “Shottr”, a desktop application developed by Company for use on macOS.

 

By using Shottr, User agrees to be bound by this Agreement. If User does not agree to be bound by this Agreement, User should not use Shottr.

 

1. Use of Shottr

User is granted a non-exclusive, non-transferable, limited license to use Shottr. User may use Shottr for free, but after thirty (30) days of use, the app will ask User to consider purchasing a license to support the development of the app.

 

If User decides to use Shottr for commercial purposes, User must purchase a license from Company for such use.

 

If User decides to purchase a license, User may be granted access to additional features and will receive priority technical support.

 

2. Refund Policy

If User is not satisfied with Shottr after purchasing a license, User may request a refund within fourteen (14) days of purchase. Company will process the refund as soon as possible, but no later than thirty (30) days after the refund request is received.

 

Please note that the refund policy applies only to purchases made directly from Company. If User purchased Shottr through a third-party platform, such as the Mac App Store, User should consult the refund policy of that platform.

 

3. Image Uploading Functionality

The image uploading feature is intended for sharing static screen-size screenshots with private parties.

 

Uploaded images become public and should be treated as such. Anyone who finds, guesses, or otherwise obtains an image URL can see the uploaded image.

 

The image uploading feature should not be used for the following purposes:

• Hosting static images embedded elsewhere.
• Sharing images that are not screenshots.
• Sharing private or sensitive information.

You agree not to upload and/or share images containing the following content:

• Private or sensitive information.
• Images that are illegal or violate any United States laws.
• Pornography, adult, mature, or obscene content.
• Images protected by intellectual property laws, unless you own or control the rights.
• Violent images of any kind.
• Images promoting hatred of any kind.
• Images depicting or otherwise promoting drugs.
• Content that promotes illegal activity.
• Content that can be potentially malicious.

Uploading such images will be considered abuse, and will result in revoking the uploading privileges.

 

Company will use its discretion to determine if any given image falls under any of the categories above.

 

Every uploaded image will be moderated, both automatically and manually. If the image is deemed inappropriate, it may be removed without notice.

 

Company provides no guarantee regarding image storage time and availability.

 

4. Intellectual Property Rights

All intellectual property rights in Shottr, including but not limited to patents, copyrights, trademarks, and trade secrets, are owned by Company or its licensors. User acknowledges and agrees that User has no rights or interests in Shottr except as expressly granted in this Agreement.

User may not copy, modify, distribute, or reverse engineer Shottr or any part thereof, except as expressly authorized by Company in writing.

 

5. Disclaimer of Warranties

Shottr is provided "AS IS" and without warranty of any kind. Company makes no representations or warranties, express or implied, regarding the quality, accuracy, reliability, completeness, suitability, availability, or performance of Shottr or any part thereof.

 

6. Limitation of Liability

In no event shall Company be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use Shottr, even if Company has been advised of the possibility of such damages.

 

7. Indemnification

User agrees to indemnify and hold harmless Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with User's use of Shottr.

 

8. Miscellaneous

This Agreement constitutes the entire agreement between User and Company and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between User and Company.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
